1. Services
The Photographer agrees to provide photography services to the Client. The scope of services, along with the date, time, and location of the photography session, will be agreed upon by both parties prior to the session.
2. Copyright & Photo Usage
- The Client retains full copyright and exclusive rights to all images created during the photography session.
- Images are for the Client's personal and/or professional use only (such as social media, resumes, LinkedIn, portfolios, and applications).
- The Photographer is prohibited from reproducing, selling, sharing, or using the Client's photographs for portfolio displays, social media posts, promotional materials, or any other public distribution, except where the Client has provided prior written authorization.
3. Image Delivery
- Final images are delivered digitally via an online gallery.
- The number of final images delivered depends on the package purchased.
- The Photographer is not obligated to deliver every image taken during the session.
4. Cancellation & Rescheduling
- The Client may cancel or reschedule with at least 72 hours' notice to apply the deposit to a future session or receive a 50% refund.
- Cancellations with less than 24 hours' notice result in forfeiture of the deposit and a $50 fee per booked hour; no refund is given, but the Client may reschedule once for free within 3 months, based on the Photographer's availability.
- If Creative Wills Photography is unable to perform the session due to illness, emergency, act of God, or any other circumstance beyond its control, the Client will receive a full refund of any payments made, with no further liability.
5. Refund Policy — Portrait Sessions & Prints
- No refund is given under any circumstances if the Client fails to attend the session on the date and at the time listed when the booking was made.
- Because digital photographs, once sent, cannot be returned, Creative Wills Photography has a strict no-refunds policy. Once a photo has been selected and delivered correctly, the transaction is non-refundable.
- Refunds are not given for reasons such as not liking a photo, or for selecting an incorrect photo after already receiving it.
- If an incorrect photo is sent in error, as documented on the invoice, Creative Wills Photography will send the correct photo free of charge.
6. Booking & Deposit
- A non-refundable deposit of 50% is required to confirm a date and time, unless the total package cost is under $150.
- Accepted deposit payment methods are Cash, Cash App, or a secure Stripe link.
- Reservations may be canceled if the deposit is not received within 24 hours of booking.
- Paying the deposit serves as a formal agreement to all Creative Wills Photography policies.
7. Payment
Full payment for the session is due immediately following the conclusion of the shoot. Checks are not accepted.
8. Lateness Fees
- A $50 fee is charged for every 15-minute interval the Photographer is kept waiting by the Client, and the session will not be extended to accommodate lateness.
- If lateness exceeds 35 minutes, the session may be canceled and the deposit forfeited.
9. Weather & Location Conditions
In the event of inclement weather or complications with the location, the Photographer will work with the Client to reschedule or find an alternative solution at no additional cost.
10. Equipment Damage Policy
The Client is financially responsible only if they physically handle or directly cause damage to the Photographer's equipment during the session. Accidental technical issues, malfunctions, or natural wear are the sole responsibility of the Photographer.
11. Liability Limitations
The Photographer shall not be held liable for any injuries the Client may incur during the course of the session.
